Introduction

• The website http://wise-tech.co.il (the “Site”) is operated by Wise-Tech Ltd. (“Wise-Tech Ltd.” or the “Company”) and also serves as a sales site for the purchase of test equipment (the “Product”).

• The use of masculine language in these regulations is for convenience only, and the regulations apply to all genders equally.

• Purchase through the Site is subject to the terms detailed in these regulations.

• The very act of purchasing the Product on the Site constitutes a declaration by the customer that they have read the provisions of these regulations, understood them, and agreed to them. The regulations constitute a binding contract between you and the Company.

Purchase

• The Site allows customers to buy the Product conveniently, easily, and safely via the Internet.

• The Product can be purchased on the Site at any time until stock runs out.

• Purchase on the Site is by credit card only, and the transaction will be executed after approval by the credit card company.

• The price of the Product on the Site does not include VAT.

• The Company reserves the right to stop marketing and selling the Product at any time and to deny the right to purchase on the sales site at its sole discretion.

Returns and Cancellations

• The transaction can be canceled by contacting the Company’s customer service by phone or email. The cancellation of the transaction will be valid only after receiving a fax or email from the Company confirming the request to cancel the transaction. In case the cancellation is approved – the Product must be returned to the Company, with all costs involved in returning the Product borne by the customer. The return of the Product shall be done in its original packaging, accompanied by the original invoice, and provided that 14 days have not yet passed since the date of purchase of the Product.

• In case of cancellation of the transaction, the Company will return the money to the customer in the same way the customer paid, minus a cancellation fee of 100 NIS.

• If the cancellation of the transaction is made after the customer has already received the Product, the customer will bear the cost of shipping the Product back to the Company, in addition to the cancellation fee.

• The cancellation policy detailed above applies only to products purchased on the Site. The Company will not handle the return of products purchased through another source.

Supply and Transport of the Product

• The Company will ensure the supply of the Product to the customer at the address typed by them at the time of purchase on the sales site, within 14 business days.

• The Company shall not be responsible for any delay and/or lateness in supply and/or non-supply caused by force majeure and/or events not under its control.

• Shipment of the Product will be made to the address provided by the customer at the time of purchase; the customer may collect the Product independently.

• The price of the Product does not include the shipping cost.

• The shipment will be sent via UPS at a cost of 60 NIS + VAT per unit, 90 NIS + VAT for two units, and 110 NIS + VAT for three units or more.

Warranty and Service

• The warranty for the Product covers material defects in the body of the Product and/or its operation which were caused by the Company.

• The warranty for Sonel products is given back-to-back according to the warranty provided by Sonel company and from the date of purchase.

• The warranty is valid only for a customer holding original proof of purchase and only if the purchase was made through the sales site of Everest Technologies Ltd. [Note: The Hebrew text mentions “Everest Technologies Ltd.” here; please verify if this should be “Wise-Tech Ltd.”]. The Company reserves the right to require the customer to prove that they are the original purchaser of the Product.

• The exclusive remedy for any defective product covered under the warranty is limited to the repair or replacement of the defective product. The total liability of the Company regarding any defective product shall in no case exceed the purchase price of the defective product.

• The Company’s warranty shall not apply in cases where the defect in the Product was caused by incorrect operation.

• The Company shall not be liable for any direct or indirect damage resulting from the use or incorrect use of the Product, including any incidental, special, indirect, or consequential damage – to the extent permitted by law. The customer bears the responsibility and all risks and liabilities for loss, damage, and injury to their body and/or property and/or the property and/or bodies of third parties, resulting from the use and/or non-use of the Product.

Information Security and Privacy

• Wise-Tech Ltd. is entitled to use the information appearing in the form in order to bring you the requested information and services.

• The Company takes acceptable precautions to maintain, as much as possible, the confidentiality of the information. in cases that are not under the Company’s control and/or resulting from force majeure, the Company shall not be responsible for any damage of any kind, direct or indirect, caused to the customer, if this information is lost and/or unauthorized use is made of it.

• The Company undertakes not to make use of the information provided to it by the buyers except to enable the purchase on the sales site and in accordance with any law.

• The “Send” button constitutes consent for Wise-Tech Ltd. or anyone on its behalf to use this personal information to provide you with information about the products and additional information via email or otherwise, about services and resources related to the Company’s products. In addition, this personal information may be used for market research purposes. If you wish to remove your personal details from the Company’s distribution list at any time, please send an email to sales@wise-t.co.il.

Intellectual Property

• All intellectual property rights in this sales site are the exclusive property of Wise-Tech Ltd.

Law and Jurisdiction

• The interpretation and enforcement of these regulations and/or any action or dispute arising from it shall be done in accordance with Israeli law only, and the competent court in the Tel Aviv-Jaffa and/or Petah Tikva district shall have exclusive jurisdiction.
